ARTICLE 1: SCOPE AND ACCEPTANCE

These sales conditions are concluded between, on the one hand, the company DIGITAL Y, a single-shareholder company with a capital of 1000 euros, whose headquarters are located at 13 Allée Turcat-Méry, 13008 Marseille, FRANCE, registered at the Marseille Trade and Companies Register under the number 979042454, hereinafter referred to as "SASU DIGITAL Y", and, on the other hand, any natural or legal person referred to as "Client" wishing to make a purchase via the website www.milijou.com, hereinafter referred to as "the Site".

These sales conditions define the contractual relationship between DIGITAL Y and the Client and the conditions applicable to any purchase made via the online store of DIGITAL Y, whether the Client is a professional or a consumer. The acquisition of a product or service through this website implies the Client's unconditional acceptance of these general sales conditions. These sales conditions shall prevail over any other general or specific conditions not expressly agreed to by DIGITAL Y. DIGITAL Y reserves the right to modify its sales conditions at any time. In this case, the applicable conditions will be those in effect on the date of the Client's order.

ARTICLE 2: PRODUCTS

On the website www.milijou.com each product has a Product Sheet listing all the product's features. This allows you to know, before finalizing your order, all the essential characteristics.
Photographs, graphics, texts: www.milijou.com strives to be as precise as possible and to respect the reality of the products. If a description error occurs on a product, we commit to correcting it as quickly as possible. However, we cannot be held responsible for any modifications made to the products, as they may be altered without notice by the manufacturers. Product photos are non-contractual. Prices, descriptions, and colors of products on our online catalog are for informational purposes only and may be modified based on supplies, economic conditions, or market trends. The choice and purchase of products are the Client's responsibility. The inability to use the purchased product for any reason does not engage the responsibility of DIGITAL Y. The products offered by www.milijou.com comply with current French legislation. Our responsibility cannot be engaged if the legislation of the country to which the products are delivered is not respected. It is the Client's responsibility to verify with local authorities the import or use possibilities of the products or services they wish to order.

ARTICLE 3: PRICES

1 Price Display

The prices displayed on the Site are in euros (€), including all French taxes (VAT and any other applicable taxes). Prices can be modified at any time, unilaterally, without prior notice, based on supplies, economic conditions, and the pricing policy of various stakeholders: manufacturers, wholesalers, and DIGITAL Y. We invoice based on the applicable rate at the time of the order: the rate seen online at the time of order validation.

2 Sales Outside Mainland France

Any sale to a country outside of mainland France places the Client in the position of an importer, who will be solely responsible for the entry of the products into the destination territory, will carry out all the necessary steps, and will bear all taxes, customs duties, and related payments.

ARTICLE 4: ORDERS

Any order placed on the www.milijou.com website is subject to payment. Orders are effective once payment has been validated by the banking institutions for payments made via credit cards, Apple Pay, or Google Pay. For fraud prevention purposes, the Client may be asked to provide documents verifying their identity and the validity of the order. In such cases, the order will only be validated once the documents have been approved by DIGITAL Y's services. The seller reserves the right to cancel or refuse any order from a Client with whom there is a dispute related to the payment of a previous order. Any order implies acceptance of the prices and descriptions of the products available for sale. The Client's acceptance, similar to an electronic signature, is formalized by the acceptance during the order process (step 4 – shipping costs). This electronic signature is considered as a handwritten signature between the parties. The electronically validated order is a final order and cannot be retracted. DIGITAL Y will send an email confirmation of the order.

ARTICLE 5: DELIVERY

1 Shipping Costs

For shipments within mainland France, Corsica and Monaco, shipping is free.

For shipments outside of mainland France, shipping costs vary and are automatically calculated based on the weight of your order, the destination country, and the chosen shipping method.

2 Shipping Time

Any item in stock is typically shipped within 24 to 48 hours. In other cases, availability is specified on the product page and may range from 3 to 30 days depending on the type of products ordered. Shipping times are provided for informational purposes only; if they exceed 30 days from the order date, the sales contract may be canceled and the Client refunded.

3 Delivery Time

The ordered product is delivered via postal services or an independent carrier, depending on the nature of the product and at the exclusive discretion of DIGITAL Y, to the address listed on the order form. The announced times are from the departure of our warehouses. The choice of delivery method depends on the weight of the ordered items. Delivery time for your package depends on the carrier used.

These times are for informational purposes only, and our responsibility cannot be engaged in the event of delays during delivery.

4 Delivery Area

Online sales of products and services presented on the site are offered to buyers residing in mainland France, Corsica, Monaco, and EU countries.

5 Transport

The risks related to transport are borne by the seller, provided the buyer has checked the goods upon receipt in the presence of the carrier and has written any observed reservations on the transport slip, if necessary, even in the case of free shipping. If the package is excessively damaged, the buyer must refuse it. In the event of reservations made upon receipt, they must also be declared by registered mail to the carrier within 48 hours and sent in copy to DIGITAL Y at the same time.

Any damaged package must be kept available for the carrier for retrieval and possible reimbursement.

Dans le cas d’une perte de colis lors du transport, les délais d’enquête peuvent varier selon les transporteurs et prendre d’une à trois semaines. Si à l’issue de l’enquête, le transporteur déclare avoir livré le client, aucun remboursement ne pourra être prétendu par ce dernier. Dans le cas contraire – si le colis est avéré perdu et/ou non livré – il sera remboursé au client ou remplacé selon le désir de celui-ci.

6 Pickup Point

For any order not picked up at the pickup point within the specified time and returned to DIGITAL Y, no refund will be made. Alternatively, upon request, the order will be refunded with a deduction of a €10.00 processing fee and the shipping costs for both the outbound and return shipment.

7 Return of Package Due to Incomplete or Insufficient Address, or No Response to Delivery Attempt

Any order with an incomplete address or awaiting instructions after a delivery attempt left by the carrier, which is returned to us by the carrier, will result in a refund of the order amount, minus the actual transport costs (outbound and return), plus a €10.00 fee for order preparation and processing.

ARTICLE 6: PAYMENT

Any order placed on the www.milijou.com website requires full payment at the time of order. All orders must be paid in euros (€). For all payments made on the website, the seller reserves the right to request the buyer to prove their identity and residence in order to accept the sale.

1 Payment by Credit Card

Payment can be made by credit card, such as CB, VISA, ApplePay, GooglePay, or MASTERCARD. Our partnership with WooPayment guarantees a fully secure payment and data confidentiality. 2 Retention of Ownership

Under the law of May 12, 1980, ownership of the delivered goods will only transfer to the Client once full payment has been made for the principal and accessory price.

3 Late Payment

Any payment made after the due date may incur penalties without the need for prior notice to the buyer. These penalties will be at least equivalent to the application of a rate equal to 1.5 times the legal interest rate in effect at the time the penalties are applied, without excluding any additional damages. The client may never, on the grounds of a claim, withhold all or part of the amounts owed, nor make any compensation. If the Client is late in full or partial payment, DIGITAL Y may, without prior notice, immediately suspend deliveries without the Client being entitled to claim damages.

ARTICLE 7: SATISFIED OR REFUNDED

In accordance with Law 2014-344 of March 17, 2014, in the context of distance selling, the client has a withdrawal period of 14 days from the delivery of their order, which will be refunded upon return of the delivered products, excluding return costs. The client must return the goods in their original state and packaging within 14 days, and under the following conditions:

  • Any return must be requested via email (with acknowledgment of receipt) to: contact@milijou.com. Return shipping costs are at the client's expense. No return will be accepted without the return number clearly indicated on the package. Products returned to DIGITAL Y must be in their original packaging and condition.
  • Any package sent to DIGITAL Y must be in a tracked postal format (Colissimo tracked, registered mail, or Chronopost). In case of a dispute, DIGITAL Y will require the Client to provide proof of deposit at the postal service.
  • Once the package is received by DIGITAL Y, our team will assess the condition of the returned goods. DIGITAL Y reserves the right to refuse the package, the refund, or the exchange if the aforementioned return conditions are not met.

ARTICLE 8: REFUND

If DIGITAL Y processes a refund for products, it will be done, at DIGITAL Y's discretion, either by crediting your bank account or by issuing a check addressed to the client who placed the order, and to the billing address within 14 days of the refund notification.

ARTICLE 9: LIABILITY

DIGITAL Y, during the online sales process, is only bound by an obligation of means; its responsibility cannot be engaged for any damage resulting from the use of the Internet network, such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

ARTICLE 10: INTELLECTUAL PROPERTY

All elements of the DIGITAL Y site are and remain the intellectual property and exclusive property of DIGITAL Y. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, any elements of the site, whether software, visual, or audio, without prior consent.

ARTICLE 11: PERSONAL DATA

In accordance with the provisions of the Data Protection Act of January 6, 1978 (amended by the law of August 6, 2004, relating to the protection of individuals concerning personal data processing), you have the right to access, rectify, or oppose the personal data collected about you.
